Probate Administration and Litigation

Probate is the process where the court oversees the administration of a deceased person's estate.  The court will ensure that the decedent's taxes and debts are paid, and that the remaining estate is distributed to the beneficiaries named in the decedent's will.  If the decedent died without a will (intestate), the court will direct that the remaining estate be distributed to the decedent's heirs at law, in accordance with Texas law governing intestate succession.

Trust and Estate Planning, Administration and Litigation

We offer services in all aspects of trust planning, including creation, administration and litigation.  We are experienced in creating revocable and irrevocable trusts, including Special Needs Trusts for disabled persons and Trusts for Minors under the Texas Probate Code.  In addition, we represent clients in guardianship matters involving incapacitated persons.  Our trust administration services include complex estate matters and post-mortem tax planning, and we provide clients with representation in estate and trust litigation in trust and will contests, interpretation of documents, accounting disputes, trustee removals and trust termination.

Guardianships

A guardianship is created in Texas when a court finds that a person is unable to manage their own physical well-being or assets and appoints a guardian to care for them.  This can happen in cases of personal injury where an adult is injured and becomes incapacitated mentally or physically.  Parents can also appoint guardians for their minor children should they die or otherwise become unable to care for them.  Our attorneys provide comprehensive estate plans, considering the possibility of subsequent incapacity and planning for the management of the client's personal and financial affairs, and can represent clients when the need for a guardianship may arise.
